TERMS AND CONDITIONS OF THE EUROPEAN CULTURAL CONGRESS 8-11 SEPTEMBER 2011, WROCŁAW

1. General provisions
1. 1. The European Culture Congress, hereinafter referred to as the “ECC”, will be held between 8 and 11 September 2011 in Wrocław.

1.2. The ECC is organized by the National Audiovisual Institute, with its registered seat at Wałbrzyska 3/5, 02-739 Warszawa, hereinafter referred to as the “Organizer”, and the Municipality of Wrocław.

1.3. The ECC may be attended by:

- Persons who received invitations to participate in the Congress and registered properly by 31 July 2011,
- Persons who purchased accreditation referred to in paragraph 2 of these Terms and Conditions,
- Persons who registered for the following concerts: “Krzysztof Penderecki & Jonny Greenwood”, “Krzysztof Penderecki & Aphex Twin”, and the concerts held as part of the “Scary Monsters and Super Creeps” project, entry on presentation of free tickets, according to paragraph 3 of these Terms and Conditions,
- Persons who registered last minute during the ECC for events where entry is conditional upon presentation of a valid ticket, should there be any seats left, according to paragraph 4 of these Terms and Conditions,
- Invited persons who received a personal invitation from the ECC Organizer.

1.4. Provisions of these Terms and Conditions shall constitute an integral part of registration for the ECC and shall be mandatory for all Participants.

1.5. The official ECC website is http://www.culturecongress.eu .

1.6 Accreditation is a cardboard ID badge with a unique bar code and full name of the person who bought accreditation.

1.7. Ticket is a printout with a unique bar code and full name of the participant.

1.8. Accreditation Pavilion is a place prepared by the Organizers where accreditations and free tickets are distributed. It will be located in the area between the Spire and the Centennial Hall at Wystawowa 1 in Wrocław. The Accreditation Pavilion will be open starting September 7th between 2 p.m. and 9 p.m. and in the period 8-11 September from 9 a.m. to 9 p.m.

1.9. The organizer keeps the right to use the e- mail address given during registration to inform ECC members about changes in the events’ schedule or about regulations, as well as for promotional purposes.

2. Terms and conditions of on-line sale of accreditations for the European Culture Congress
2.1. The number of accreditations on sale shall be limited. The applications for purchase shall be accepted until the available accreditation pool is sold out.

2.2. Accreditation sales shall run since 1 July 2011 until all tickets available are sold out, however no longer than until 31 July 2011.

2.3. Accreditation sales are conducted exclusively on-line:
- purchase can be made via the Polish version https://rejestracja.culturecongress.eu or English version https://registration.culturecongress.eu of the website.

2.4. Accreditation purchase entitles to:
a) Reserve a seat for selected ECC events with a limited number of participants. The events subject to reservation are the following:
- ECC inauguration ceremony and inauguration lecture by Prof. Zygmunt Bauman,
- 10 meetings/discussions,
- debate organized by "A Soul for Europe" initiative,
- shows as part of “Sound Cinema” and “Funny Games EU” projects,
- theatre events and performance as a part of “Trickster 2011" project,
- “We Are More” workshops,
- “Krzysztof Penderecki & Jonny Greenwood” concert,
- “Krzysztof Penderecki & Aphex Twin” concert,
- concerts as part of “Scary Monsters and Super Creeps”,
- ECC closing ceremony.

b) Enter a contest for taking part in the “LUNCH with ...” contest – the rules of the contest will be published not later than 15 August 2011.

c) Participate in all open curatorial projects.

Enter the festival club, subject to availability.

d) Receive an ECC welcome package free of charge.

Free coffee breaks during meetings.

Free city transport in Wrocław between 8 and 11 September 2011.

2.5. The ECC event schedule is available at: www.culturecongress.eu/program.
An accreditation holder may reserve more than one event held at the same time on the same day.

Accreditation entitles holders to enter selected events’ venues only until the starting time of an event.

For those who are late, registration for a given event will be cancelled automatically, regardless of the reason for being late.

Reservation of tickets for a given event in the registration system is processed on a first-come, first-served basis.

Accreditation is personal – it will be issued in the full name of an applicant, given in the registration form. A person whose registration was successful shall be hereinafter referred to as the “ECC Participant”.

2.6. Rights to accreditation may not be ceded to another person.
Accreditation may not be returned nor the selected events changed.

2.7. The accreditation fee is PLN 100 or EUR 25, VAT included.
The accreditation fee shall be paid to the Organizer’s account via the e-Card SA system accessible through the ECC registration system. Accreditation payment can be made by Visa, Mastercard or JCB, or a fast transfer from the e-Card SA payment platform.

An individual or economic entity making a payment, hereinafter referred to as the “Payer”, shall receive an e-mail message, sent to the e-mail address given in the registration form, with a VAT invoice confirming granting accreditation entitling the ECC Participant to take part in selected ECC events. An invoice will be issued automatically for the Payer.

A VAT invoice correction may be requested not later than 7 days after the end of the ECC. You need to contact the Organizer directly.

When purchasing accreditation for a third person, the Payer confirms that he/she possesses an authorisation from such a third person to submit all necessary statements to fulfil the requirements of these Terms and Conditions.

Once purchased, the accreditation may be collected in the Accreditation Pavilion in person only, subject to presentation of a valid ID (identity card, driving licence or passport). Personal data are administered by the Organizer and e-Card SA.

The personal data of the ECC Participant or the Payer shall not be revealed to other entities without knowledge and consent of the persons concerned. The ECC Participant or the Payer shall be entitled to access and modify their personal data. The accreditation purchase shall be tantamount to accepting these Terms and Conditions and making the personal data of the ECC Participant and/or the Payer available to the Organizer and e-Card SA.

2.8. The Organizer reserves the right to introduce changes to the ECC programme.

3. Terms and Conditions of Registration for Free Tickets for “Krzysztof Penderecki & Jonny Greenwood” and “Krzysztof Penderecki & Aphex Twin” concerts, as well as concerts held as part of the “Scary Monsters and Super Creeps” project
3.1. Registration for free tickets for concerts is subject to availability. Applications for registration shall be accepted until the available pool of tickets for individual concerts is sold out.

3.2. Registration shall run since 1 July 2011 until all tickets available are sold out, however no later than until 31 July 2011. Registration is conducted exclusively on-line: in Polish at: https://koncerty.culturecongress.eu , and in English at: https://concerts.culturecongress.eu .

3.3. Each person making reservation is entitled to only ONE free ticket for each of the concerts offered during the registration procedure.

3.4. A personal ticket, in the form of a PDF-document with a unique bar code, for concerts selected during registration, will be sent via e-mail to the e-mail address indicated in the registration form.

3.5. A registration holder shall be obliged to print out his/her ticket on an A4 sheet and present it at the entrance to the concert.

3.6. Tickets that are damaged or tickets with an indecipherable bar code are not valid and will not be accepted. Only persons with valid tickets will be admitted to a concert.

3.7. Ticket printing before concerts is not allowed by the Organizer.

3.8. Those who arrive late for concerts in the Centennial Hall will not be allowed to enter – a ticket shall be valid only until the starting time of the concert, indicated on it.

3.9. The personal data administrator is the Organizer.

3.10. The personal data of the ECC Participant shall not be revealed to other entities without their knowledge and consent. The ECC Participant shall be entitled to access and modify their personal data.

3.11. The Organizer reserves the right to introduce changes to the concert programme.

4. Remaining available seats
4.1. Once concerts start, tickets for these concerts are no longer valid. Should there be any available seats left, the Organizer may, first of all, admit Volunteers, unless they are executing their tasks at this time.

4.2. Then, all persons interested may be allowed to enter, providing they present a relevant “last minute” ticket.

4.3. Free of charge “last minute” tickets shall be issued upon registration in the Accreditation Pavilion.
A “last minute” ticket shall be issued once and shall be valid for all ECC events. No duplicates will be issued.

5. Terms and Conditions of mass events – “Krzysztof Penderecki & Jonny Greenwood”, “Krzysztof Penderecki & Aphex Twin” – held in Wrocław in the Centennial Hall at Wystawowa 1 on 9 and 10 September 2011 as well as concerts being as part of the “Scary Monsters and Super Creeps” project held in Wrocław on the IASE parking lot at Wystawowa 1 between 8 and 10 September 2011.
5.1. Participants of the event may stay only in the places indicated by the Organizer.

5.2. Persons staying at the event’s venue are obliged to follow the instructions of information and policing services of the event organizer, aimed at ensuring safety and order.

5.3. The following may not be brought to the event’s venue and possessed during the event: weapons and other dangerous objects identified in the Act on Weapons and Ammunition, explosives, pyrotechnic devices, fire hazardous materials, alcohol drinks, intoxicants or psychotropic drugs.

5.4. It is prohibited to smoke at the mass event’s venue.

5.5. Policing and information services of the event organizer, equipped with relevant ID badges, shall be entitled to:

a) Verify and establish the right to participate in a mass event, and in the event of establishing the lack of such rights – to order such persons to leave the mass event’s venue.

b) Check identity of persons.

c) Search through the baggage and clothing of persons suspected of bringing in or carrying items referred to in paragraph 5.3 of Terms and Conditions.

5.6. An ID badge of information and policy services of the organizer shall include: name of the issuer, identification number and face photo, validity date and issuer’s stamp and signature.

5.7. The following will not be allowed to enter the event’s venue: intoxicated, under the influence of intoxicants, psychotropic or other substances having similar effects, behaving aggressively, provocatively or in another way posing a threat to safety or public order, possessing items identified in paragraph 5.3 of Terms and Conditions, refusing to subject themselves to the activities referred to in paragraph 5.5.a)-c) of Terms and Conditions, and persons prohibited to attend mass events by court judgement.

5.8. Persons behaving in a way that distorts the public order or violating the Terms and Conditions of the event will be removed from the event's venue.

5.9. Persons clearly posing a direct threat to human life and health and to the protected property will be apprehended with the aim of handing over to the police.

5.10. It is prohibited for participants of a mass event to record or take photos without the Organizer’s consent. Consent must be in writing, under pain of nullity.

5.11. Persons destroying equipment or devices at a mass event’s venue shall be financially liable for any damages made.

5.12. Furthermore, the provisions of the Centennial Hall Terms and Conditions shall apply to participants of mass events.

5.13. TERMS AND CONDITIONS OF MASS EVENTS ARE AVAILABLE ON-LINE AT: WWW.CULTURECONGRESS.EU AND IN THE FORM OF ANNOUNCEMENTS AT THE MASS EVENT’S VENUE.

6. INTERPRETATION/HEADPHONES
6.1. Meetings and debates will be translated simultaneously.

6.2. The ECC participants will be provided with headsets for simultaneous translation. A headset will be issued provided that a valid ID document with a photo is left instead.

6.3. Headphones will be issued and collected on each day of the ECC.

6.4. If headsets are:
a) lost,
b) not returned,
c) returned incomplete, damaged or broken,
the Organiser shall charge the person who took headphones with a fee of PLN 1,000.

7. Organizers reserve the right to publish and reserve materials related to the course of the ECC and make such materials available to third persons, as well as to use the images of persons recorded in these materials.

8. Amendments to Terms and Conditions
8.1. The Organizer reserves an exclusive right to introduce amendments to these Terms and Conditions, which do not violate the basic rules of the ECC. Amendments to these Terms and Conditions may not violate the rights acquired by the Participants. Justification of amendments is not required.

8.2. Any information about amendments or introducing corrections to the Terms and Conditions shall be immediately published at: www.culturecongress.eu.
